The CR also clarifies policy for the local determination of payment limits for drugs that are not nationally determined. This article notes that CR 7397 rescinds and fully replaces CR 7109. The proposals would affect payments for dialysis treatments furnished on or after January 1, 2012 under the new bundled ESRD Prospective Payment System (PPS) that was implemented in calendar year (CY) 2011. This shall be done to ensure that the refilled item remains reasonable and necessary, existing supplies are approaching exhaustion, and to confirm any changes/modifications to the order. Contact with the beneficiary or designee regarding refills must take place no sooner than 14 calendar days prior to the delivery/shipping date. For delivery of refills, the supplier must deliver the DMEPOS product no sooner than 10 calendar days prior to the end of usage for the current product. This is regardless of which delivery method is utilized. DME MACs will allow for the processing of claims for refills delivered/shipped prior to the beneficiary exhausting his/her supply.
